Conditions generales de vente

PLACEMENT OF ORDERS
The preparation of an order is based on the acceptance of the Gen-
eral FREZITE Sales Conditions and the express confirmation of the
latter by the customer.
All orders must include the necessary data to clearly define the tool to
be delivered, and the customer shall be responsible for supplying all
elements (drawings, samples and other). These elements will be kept
by FREZITE for a period of six months and shall only be returned to
the customer when requested in writing. The cancellation or altera-
tion of the order by the customer requires the express consent and
permission of FREZITE, and all costs shall be borne by the customer.

DELIVERY AND RETURN TIME
The order delivery times are not binding but merely indicative, and
therefore does not confer the right, due to any delays, to penalties
or cancellation of the order. FREZITE does not accept the return of
special tools. Any other return requires the prior written permission of
FREZITE and it shall not be responsible thereof. The company shall
have the right to pass on to the customer 5% of the value of the re-
turn, deemed to be handling costs.

SHIPMENTS
The goods sent by FREZITE are transported at the customer’s ex-
pense and risk, even with postage paid at origin. Insurance to cover
any loss for damage or loss suffered during shipment will only be
applied upon the written request of the customer, who will be liable
for the costs thereof.

PRICES
The prices shown in the tables and budgets are free of taxes and
fees, and only reflect the value of the product in storage.
The amounts stated in the invoice represent the applicable prices as
at the date of the issue thereof. The prices for the special tools must
be stated and confirmed in the order.

RESERVATION OF OWNERSHIP
Until full payment is made of the tools supplied, FREZITE reserves
the right of ownership over the same.

WARRANTY
FREZITE, as a certified company, warrants the quality of the tools it
produces and supplies. Defects, however, arising from the incorrect
use and/or normal wear of the tool are not covered by the warranty.
The warranty only covers the replacement or repair costs of the tool
when it is recognized by FREZITE as being defective. Complaints
must be lodged in writing and duly substantiated in order to be taken
into consideration.

SAFETY
The tools for woodworking and plastic are considered dangerous
tools because of their cutting angles which are usually positive, their
very sharp cutting edges and high working speed. Therefore, they
require a secure and reliable construction, to reduce the risks to the
user. FREZITE tools are designed and produced in accordance with
European Standard EN 847 1-3 with respect to safety, design and
quality requirements.

GENERAL INFORMATION
FREIZITE reserves the copyright over all documents, whether im-
ages, sketches, samples or otherwise, and does not consent to their
change or disclosure to third parties without its prior express consent,
given in writing.
FREZITE is entitled to make any technological and graphic changes
without prior notice. The place for fulfilment of the contract concluded
with the customer shall be the registered office of FREZITE in Trofa,
Portugal. It is expressly established that the Forum for the District of
Santo Tirso shall have jurisdiction to determine any disputes arising
from it, to the exclusion of all others.

CONDITIONS DE VENTE
La création d’une commande doit impérativement accepter les
Conditions Générale de Vente FREZITE et la confirmation explicite
de la part du client. Toutes les commandes doivent contenir toutes
les données pour ce qui concerne la description de l’outil, ayant
le client la responsabilité de fournir tous les éléments nécessaires
(dessins, échantillons, entre autres). Ces éléments seront conservés
pendant une période de six mois par FREZITE et ils seront rendus
aux clients, quand ceux-ci les solliciteront, par écrit. L’annulation ou
la modification de la commande par le client doit recevoir l’accord
et l’autorisation exprimée de FREZITE, dont tous les frais inhérents
doivent être imputés au client.

DÉLAI DE LIVRAISON ET RETOURS
Les délais de livraison des commandes n’ont pas un caractère
contraignant mais simplement indicatif. En cas de retard, cela ne
donne pas le droit à des pénalisations ou à l’annulation de la com-
mande. FREZITE n’accepte pas le retour d’outils à fabrication spé-
ciale. Le retour d’un outil doit avoir l’autorisation préalable de
FREZITE et son coût ne doit pas lui être imputé, ce donnant même
le droit de demander au client 5% de la valeur en retour comme frais
de manutention.

EXPÉDITIONS
Bien que les frais de port soient payés à la source, les marchan-
dises voyagent et circulent au risque du destinataire. L’assurance
qui couvre tous les dommages et pertes causés aux objets assurés
pendant le voyage, devra être requise par écrit et payée par le des-
tinataire.

PRIX
Les prix tarif et les devis présentés ne comprennent pas les taxes
mais simplement la juste valeur du produit en magasin. Les mon-
tants présentés sur la facture traduisent les prix en vigueur lors de
la date de son émission. Les prix des outils à fabrication spéciale
doivent être exprimés et confirmés lors de la commande.

DROIT DE PROPRIÉTÉ
FREZITE se réserve le droit de propriété sur les outils fournis jusqu’à
ce qu’ils soient entièrement payés.

GARANTIE ET RÉCLAMATIONS
FREZITE est une entreprise certifiée et, de ce fait, garantie les outils
produits et fournis. Les imperfections d’une mise en procédé incor-
recte bien que l’usure normale de l’outil ne font pas partie de la
garantie. La garantie permet la substitution ou réparation d’un outil
quand celui-ci est reconnu par FREZITE comme ayant un défaut de
fabrication. Les réclamations prises en charges devront être présen-
tées par écrit et dûment remplies et signées.

SÉCURITÉ
Les outils pour travailler le bois et les plastiques sont considérés des
ustensiles dangereux en vertu de leurs angles de coupe positifs,
leurs arêtes de coupes très pointues bien que le fait de travailler à
grande vitesse. Les outils requièrent une construction performante
et fiable afin de réduire les risques pour l’utilisateur. Les outils FRE-
ZITE sont projetés selon la norme européenne EN 847 1-3 pour ce
qui concerne les prescriptions de sécurité, design et qualité.

GÉNÉRALITÉS
FREZITE se réserve les droits d’auteur sur tous les documents que
soient-ils des images, esquisses, échantillons, sans pour autant
concevoir leurs adultérations ou divulgation à des tiers conformé-
ment la présentation par écrit de son consentement.
FREZITE se permet le droit de faire des modifications technolo-
giques et d’image sans avertissement préalable. Le lieu d’exécution
du contrat conclu avec le client a lieu au siège social de FREZITE,
Trofa, Portugal. La résolution de n’importe quel litige aura lieu au
Foro da Comarca de Santo Tirso, à l’exclusion de tout autre.
